Business Energy Rebates Contest Rules & Regulations

The Contest, presented by Efficiency Nova Scotia, begins on Monday, September 26, 2016 and ends on January 31, 2017 (the “Contest Period”). All eligible entries received during, and still active at the end of the Contest Period will be entered in a random prize draw.
To enter the Contest, entrants must fill out an in-store ballot or visit www.efficiencyns.ca/ber/contest and provide the indicated information, acknowledging they have read, understood and agree to the Contest Rules.
The Contest is open to all legal residents of Nova Scotia who have reached the age of majority at the time of entry, except employees or agents (and their immediate family members and those with whom they are domiciled) of Efficiency Nova Scotia, Efficiency Nova Scotia’s advertising and promotion agencies and/or the Contest judges.
Only one Contest entry per individual will be accepted. Additional entries from the same individual will be excluded from the Contest and Efficiency Nova Scotia may disqualify such individual(s) completely, at its sole and unfettered discretion.
There will be one (1) prize awarded.
The Prize must be accepted as awarded and is not transferable or convertible to cash. No substitutions shall be provided except at the option of Efficiency Nova Scotia. Notwithstanding the foregoing, Efficiency Nova Scotia reserves the right to substitute a prize or a prize component with one of equal or greater value. The Prize will be delivered to the confirmed winner, as applicable, at the address provided in the entrant’s ballot.
SKILL TESTING QUESTION:
In order to be eligible to win and receive the Prize, the selected entrant shall be required to correctly answer a time-limited, mathematical skill-testing question, without assistance of any kind, whether mechanical, electronic or otherwise. The selected eligible entrant may be required to swear an affidavit indicating compliance with this requirement.
DRAW AND WINNER SELECTION:
On February 9, 2016 (the “Draw Date”), at the Efficiency Nova Scotia offices in Halifax, Nova Scotia, at or about 12:00pm (Halifax time), an eligible entrant will be selected by random draw from among all eligible entries received during, and still active at the end of, the Contest Period (each a “selected entrant”). The odds of winning depend on the number of eligible entries received. Acting reasonably, Efficiency Nova Scotia will attempt to contact the selected entrant by phone or email within two (2) business days of the applicable Draw Date. If the selected entrant cannot be contacted within two (2) days of the Draw Date or there is a return of any prior notification as undeliverable, the selected entrant will be disqualified and Efficiency Nova Scotia reserves the right to select an alternate entrant from among the remaining eligible entries. In addition to the other requirements described in the Contest Rules, before being declared the winner, the selected entrant will be required to sign and return, within two (2) business days of notification, a Prize Claim Form (attached) confirming, inter alia, compliance with the Contest Rules, acceptance of the Prize as awarded and releasing Efficiency Nova Scotia, Efficiency Nova Scotia’s advertising and promotion agencies, the Contest judges and each of their respective officers, directors, agents, representatives, successors and assigns, from any and all liability in connection with the Contest, the selected entrant’s participation therein and/or the awarding and/or use/misuse of the Prize or any portion thereof. If the selected entrant: (a) fails to correctly answer the skill testing question; or (b) fails to submit the Prize Claim Form within the specified time, then he/she will forfeit the Prize and Efficiency Nova Scotia reserves the right to select an alternate entrant from among the remaining eligible entries.
All intellectual property associated with Efficiency Nova Scotia and/or the Contest, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, logos, slogans and representations, are owned by Efficiency Nova Scotia and/or its affiliates, as the case may be. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
By entering the Contest, each selected entrant agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further compensation, in any publicity or advertisement carried out by Efficiency Nova Scotia in any manner whatsoever, including, without limitation, via print, broadcast and/or the Internet. All entries become the property of Efficiency Nova Scotia, which assumes no responsibility for lost, stolen, delayed, incomplete or misdirected entries. The Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Contest judges with respect to all aspects of the Contest are final and binding on all entrants, without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries. Upon claiming to be a selected entrant, a Prize claimant may be required to provide proof that he/she is the person associated with the selected entry, the nature of such proof to be determined solely in the discretion of Efficiency Nova Scotia.
COLLECTION AND USE OF PERSONAL INFORMATION:
By entering the Contest, each entrant expressly consents to Efficiency Nova Scotia, its agents and/or its representatives, storing, sharing and using personally identifiable information submitted with his/her entry only for the purpose of administering and/or promoting the Contest, unless the entrant otherwise agrees.
